What TDIU Is—and Who Qualifies

TDIU pays at the 100% rate even when your combined rating is lower. VA grants it when your service-connected conditions keep you from holding a steady job that pays more than a poverty-level income.

The rating requirements (38 CFR 4.16(a))

Most Veterans qualify through the schedular route. You need one service-connected condition rated 60% or more, or a combined rating of 70% or more with at least one condition rated 40% or more.

For these thresholds, VA counts some conditions as one, such as conditions of both arms or both legs, conditions from a common cause, or conditions affecting one body system. You keep your existing ratings; VA pays you as if you were rated 100%.

If you don’t meet the percentages (38 CFR 4.16(b))

You can still be considered. If the evidence shows your service-connected conditions keep you from working, the regional office must send the case to VA’s Director of Compensation Service for an extraschedular decision. That review is less common and slower, but VA’s own rule is that every Veteran unable to work because of service-connected disability should be rated totally disabled.

What “can’t hold a steady job” means

  • Marginal work doesn’t count against you. Earnings at or below the federal poverty threshold for one person are marginal employment, not a steady job.
  • A protected work setting may not count either, such as a family business or an employer making unusual accommodations.
  • VA looks at your education and work history, not at age or conditions that aren’t service connected. Age can’t be the reason for a denial (38 CFR 4.19).
  • The question is practical: could you keep a regular job given your symptoms, treatment, and the work you’re trained for? Medical and vocational opinions answer it best.

What TDIU is not

  • It isn’t a separate condition, and VA doesn’t need to find you 100% disabled on paper.
  • It doesn’t mean you can never work again. You report work to VA, and VA can review the award.
  • Once your ratings reach a 100% combined schedular rating, TDIU usually isn’t needed, though it can still matter for special monthly compensation.
